Property Rights and the Constitution
America’s Founders understood clearly that private property is the foundation, not only of prosperity but of freedom itself. Thus, through the common law, state law, and the Constitution they protected property rights— the rights of people to freely acquire, use, and dispose of property.
With the growth of modern government, however, those rights have been seriously compromised. Unfortunately, the Supreme Court has yet to develop a principled, much less comprehensive, theory for remedying those violations.
The problem is “We the People” under this de facto U.S. Corporation that has taken over our government and also our local state, and municipal governments as well, over these last 140 years, in lieu of the fact that our Constitutional Republic, which is the ONLY de jure (lawful) government that we have, has only been moth balled, so to speak, (pursuant to the passage of the Act of 1871), and since there has never been a constitutional amendment to lawfully change our de jure government from a Constitutional Republic, into a U.S. Corporation, then we still have the law on our side; and therefore we can still use the law, even in their courts, and reclaim our Constitutional Rights and re-implement our lawful property rights, as a free people.
As it stands now, for the most part, there is no real justice any more in the de facto courts, but that tide is changing, and thank God for that; because the American people are slowly but surely waking up to the fact that this de facto corporate entity, called the UNITED STATES OF AMERICA, INC, has no lawful standing under our U.S. Constitution, which still is the highest law of our land!
The fact is, this de facto D.C. Corporation has, over these last 140 years, been eroding so many of our Constitutional Rights, and have instead made them privileges which they can take away from us under their corporate code enforcement structure. I thank God that that tide is slowly changing, as We the People are learning the truth.
You need to understand that under this de facto system, even though you may have a mortgage in your name, and are making payments on time every month, or even if you already own your property outright and have the deed in your name, the fact is you still don’t own your property.
You in fact are leasing it from the de facto, and they can at anytime come in and take it from you through any number of procedures, as many of you can well testify to, because you’ve already had this happen to you.
